    Hello

    I requested a passport for my son when I became us citizen, now they're asking me for evidence that shows I was in the sole or joint legal.
    In the divorce decree, my ex-wife has sole custody because we did a verbal agreement.
    Actually, she went with me to request the passport for my son.

    If your parents were married to each other and are no longer together, examples of such evidence might include:

    - A custody decree or divorce decree addressing custody;
    - A statement from a competent authority (such as a court or state agency) certifying that your state or country of residence presumes that you are in the legal custody of your U.S. citizen parent. A letter from an attorney citing the statute is also acceptable if accompanied by a photocopy of the statute.
    I can't send the divorce decree because the document states she's has sole custody.
    I don't understand the second option "A statement from a competent ...".
    How do I get this?
    What would be the easier way to get the documentation based on the fact my exwife can sign any document and cooperate.

    Your son becomes a US citizen automatically when you do if he:

    1.) has a green card
    2.) is under 18
    2.) resides in the US in your sole or joint legal and physical custody

    You can look up The Child Citizenship Act of 2000.

    I do not think that you could get a statement from a judge or a letter from an attorney because I do not think that the U.S. (your country of residence) would that you have legal custody of your son when in fact you already have a divorce decree that says the opposite.

    You should really speak to a lawyer I think.
    You may have to renegotiate the divorce so that you get joint custody.
