I have been a permanent resident for 9 years and was granted based on my marriage to a citizen (by birth). We had been married for 9 years (prior to me filing for divorce a year ago) but had been in a relationship for a total of 17 years. We are currently in the midst of a divorce (we also have two children together) which has been going on for over a year and has not yet been finalized - I was hoping to have it finalized before filing my N400. I know that my spouse was previously married and divorced, but I don't know the details of that situation. the situation is not amicable as there is an underlying issue of domestic violence and I have a protection order against my spouse, so I can't make contact with him to get the information, not that he would give it to me anyway. Any advice when it comes to answering that question on the N400? Is there any way to get the information from my green card appliication at INS (I don't have the copies of all the documentation, he has control over them)? Any guidance would be most appreciated. Thanks in advance.

hi,
if u r filling n400 under 5yrs category no need to answer ur previous spouse marital history. in n400 part 8 question B is regarding ur present spouse not ur previous spouse.similarly in part 8 question f is just ur previous marriage details with ur previous spouse not his previous marriages other than you. so don't worry u don't need that details if u r a divorced person. go through the questions.u will know.

Thanks for the speedy response. My dilema is that the divorce is not final yet (and probably won't be before I file the N400) so, technically I am still married to the person I was married to when my permanent resident status was approved. Therefore, am I required to still answer that question about my "not-yet / soon-to-be" ex-spouse?
