I've been reading a lot of good advices from this forum and thought I would share my circumstance with you all so I can receive some guidance....
On March 1, 2010 I moved from my temporary address of Queens, New York to a permanant address of Jersey City, NJ. I filed the n-400 app on March 24, 2010. Prior to sending the N-400 on March 24, I consulted with an attorney in Queens, NY regarding above matter. The attorney advised me that under immigration law, a "District" is defined as the surrounding district of New York metro and therefore, I could apply from Jersey City, NJ since I lived in New York metro area for more than a year.
My N-400 was accepted and I was finger printed from Elizabeth NJ. Everything went fine and smooth. I was scheduled for an N-400 interview on July 29, 2010. On July 29, I went to the interview all prepared attempting to be interviewed and tested on my citizenship from 970 Broad St, Newark, NJ. However, before the substantice interview, the IO advised me that I was not meeting the NJ state residency requirement of 90 days prior to filing for my n-400. IO further advised me to withdraw the app or if we proceeded with an interview, my app would be well denied due to time of residency.
I feel that the word District from "90 days residency from State of District" is an ambiguous word in N-400 application which resulted in me withdrawing the application and re-applying again by paying another $675 including Finger Printing. The IO advised me that I may be able to bypass the Finger printing since I took the finger print on May 12, 2010.
Has anyone experienced this issue? I want to request that no additional finger print be taken so it can save me time. I waited over 4 months for an interview to find out that because I didn't live in the state for 60 more days, I had to withdraw my n-400.... I was devastated.
Please let me know if anyone of you know Finger print might be waived or bypassed in this matter. Thanks everyone for reading my post.
