  • Help! N-400 interview notice received after wrong date on green card notice

    I received my conditional green card and applied for the permanent resident green card based on marriage when I became eligible according to the "resident since date" that appears on my green card.

    After one year, according to the 3 year residency rule, I applied for naturalization/citizenship while the 10 year green card application was still pending.

    A few months later I received a letter about my 10 year green card application that stated "due to no fault of your own, the "resident since date" on my green card is incorrect and they will refund my money, close the green card case, and gave me my new date to re-apply which was about 6 months later. I needed to send back my green card and request a replacement with the correct date on it.

    My naturalization application had already been accepted and was still pending. Today, I received an interview notice to appear for my naturalization interview. -- But, now, according to the "correct" date of my residency I am not a 3 year resident until September 2021. Also, I still have not received the new green card and don't have any card with me.

    In summary, what do I do about this upcoming interview notice? Should I withdraw the application and if so how can I request my money back since the dates are incorrect due to the fault of USCIS.

    Usually, you won't get any money back if you withdraw the application.
    Call USCIS or get an InfoPass appointment and explain what happened. Maybe they will consider?

      I would go to the interview, explain the situation and they may wait to approve your citizenship until September. Just a guess, good luck.
