    I was a green card holder for 15 years starting 1971. My 2 children are born U. S. Citizens. My husband became naturalized citizen in the year 1976. We moved come back to India in 1986 because of family commitments. Now we want to go back to USA and live there with my daughter.

    Our daughter is a house wife for 10 years and settled in U. S. A. Our son in-law is a naturalized citizen, they have established themselves .
    Our son is at present transferred from USA to Asia but working for a US bank. My husband is 68 years old semi- retired and in India,,

    I could not travel to U. S. A. once every year during 1986 and 2002 to keep the green card alive. I wanted to attend my son’s graduation ceremony in May,2002, as there was not enough time available to revive the green card, I had to surrender the green card and apply for visitor’s visa and attended the ceremony then. Since then I am visiting our daughter as a visitor.


    My question is , what do I have to do to revive my green card. Who is the best person to sponsor me? How long will it take ? I would like to apply for citizenship and stay in USA.

    Is daughter a citizen?

    If your daughter is a U.S. Citizen and 21 or older she can sponsor you as an immediate relative and if you are still in lawful status it would be OK to file for adjustment of status.

    Her husband cannot sponsor you.

    A sponsor who files the I-130 has to sign your affidavit of support I-864 but can have co-sponsors to meet the income requirements, her husband CAN do that.

    If she is not a citizen, what about your son?

      Thank you for your help.Both my children are citizens, daughter is in US but son is in working in Asia.
