  • Can my wife apply for citizenship with me?

    Hi all,

    I have a naturalization question. My wife and I got married in 2013. I got my green card in 2016 but she got hers in 2018 as my spouse (I think derived benefit is the technical term). I know that I am now eligible to apply for citizenship. But, I am not sure my wife is eligible. On one hand, she has been a green card holder only for 3 years, on the other hand, she got her green because of me. Any ideas? I would appreciate the help very much.

    You are not USC so your wife can't apply using the 3-year rule (from what I read). I don't know if she can apply once you become USC using the 3-year rule even if you are not USC for long.

      The spouse of a U.S. citizen who resides in the United States may be eligible for naturalization on the basis of his or her marriage. There are five sections in the 14thAmendment that focus on US citizens’ natural rights by birth and naturalization. These individual rights were further protected by the federal government and became the responsibility of the states. There are three clauses to the Amendment.
      1. The Citizenship Clause
      2. The Due Process Clause
      3. The Equal Protection Clause.
