  • Marriage Based N400 - Early filing question

    I have been a Green Card holder for 3 1/2 years. On January 2nd, 2022 I will be married to a US citizen for 3 years.

    Does the 90 day early filing window only apply for the time needed to be a Green Card holder or also to the marriage? Can I apply 90 days before the 3 year wedding anniversary? From my reading of the USCIS website it appears it only to time as GC holder. Meaning I would have to wait until Jan 2 2022 to apply...

    Am I understanding this correctly?

        How come you have been married less than what you have had your green card? Didn't you obtain your green card by marriage?

          No, GC was employment based. Got married after I already had my GC.
