  • Can I move out of U.S. after filing for citizenship?

    Hi,

My question is after filing for citizenship, can I move out of US and come back for taking Oath?

    Thanks for the reply.

      I disagree

You have too maintain eligibility in all respects from time of application up to the time of oath.

      316(a)(2) INA

has resided continuously within the United States from the date of application up to the time of admission to citizenship

THAT means from filing the N-400 to the Oath Ceremony.

You are not forbidden to travel BUT you cannot "MOVE OUT OF THE U.S." and come back just to take the Oath.

      Don't do it.

      ASK YOUR LAWYER.
