  • Is this a reason for N400 denial?

I have been in the US and a resident alien for over 45 years. I am going to apply for citizenship and one of the questions is have you ever claimed to be a US citizen (or ever lied about it) and I have... on a job application. Not really to deceive anyone, just because it was easier. I am about as American as it gets, being of French decent and coming here when I was 3 so I have no accent. So when I answer the question honestly, that I have, will they deny my application? The fee is non refundable and it is a huge expense for me so don't want to apply for them to turn me down. I don't see a problem with any thing else in the application.
    Thank you for advise.

    Seek professional advice first

Wait a minute, you immigtated to the U.S. when you wer 3 and you've been here for 45 years?

There is a possibility that you may already be a citizen based on your parents if either or one of them natutralized or either one was a citizen when you were born. You should check that possibility out first with an immigration attorney.

    Check it out!

In the alternative, since you obviously never ran afoul of INS over that minor transgression and it is not listed in the statutory definition in section 101(f) of the Immigrationa nad Nationality Act (INA) [8 USC 1101(f) or 8 CFR 316.10 and it was probably outside your stautory period (over five years ago) and you didn't mention anything about having voted (but there is an exception for that which you might qualify for anyway) it could only come back to haunt you if you tried to lie about it. Then it could be held against you and block you for five years after lying before you'd be eligible to re-apply.

See good immigration lawyer before filing an N-400.

If you did derive citizenship from your parent(s) then you could be an axe murderer and it wouldn't prevent approval of an N-600, Application for Certificate of Ciitizenship.

    Good Luck,
