  • Please help ... my application for Naturalization

    I came here in the United States back in July 2005 on B1/B2 Tourist Visa and 3 months later on October 2005, my adjustment status thru employment (as a Registered Nurse) was approved and got my Green Card.

    Since it has been 5 years since I got my Green Card, I know I am eligible now for application of Naturalization. I've read the requirements and I know I have to submit the following:

    1. Completed Form N-400
    2. Front & Back Photocopy of Green Card
    3. Two (2) 2X2 Passport Photo
    4. Application Fee of $675

    My only concern is once I get an interview with an Immigration Officer, would they ask me about how I got my Green Card? I came here as a tourist and I am bit concerned if they ask me if I really planned of coming here 5 years ago on seeking employments and not just for a visit (tourist) and if I tell them that I didn't intend to seek employment, they might not believe me specially I am a nurse as a profession.

    I know it a bit confusing but is anyone out there who is in the same situation as I am or have been in the same situation and I would really appreciate your input. I am planning to submit my application next week and I just want to have a bit of peace of mind before I submit my naturalization application without worrying much on my interview : )

    Not to worry

    They already addressed that concern when they adjusted your status. The agency that adjusted you to immigrant status also does the naturalization determination. All that other stuff will be in the same file underneath your N-400 or during your interview.

    Your I-485 paperwork or visa packet will be there under the N-400 paperwork. In fact, if you are unable to find some item that they ask for in connection with the N-400 and you already submitted it for the I-485 or visa, just state so in a letter with the N-400.

    I've seen some folks on here worried because they can't find a certain piece of paper that they have misplace, like a divorce decree or marriage certificate or birth certificate.

    They get upset thinking they will have to fly back to China or India or their African home country to see a village elder or whatever and get a statement when that information is already in the file.

    They forgot that they already submitted it with their visa application or I-485 and it is already there under the N-400.

    Be aware that after you file the N-400, someone will do a preliminary review and may send a request for evidence for some document. The person who does that review may not have your file at that time or if they do, well, they don't think it's their job to dig under the N-400. Don't let that request worry you. If what they ask for was previously submitted you can ignore it. Even if you do have to dig something up, you can just bring it to your N-400 preliminary interview.
