I've applied for citizenship a couple of months ago, and today I finally received my YL. It says to bring my DL, and N-426 along with a G-325. I've been in the military for 4 months, 2 years ago and received an entry-level separation. I have my separation papers, but I'm not sure why I would need the N-426. I'm not applying based on military service, because I am in no way eligible. Anybody have any idea on how should I proceed, who to ask advice about this?

Another guy had a similar situation about DOD Checks, Please read that post for the reply (2 above your). And by YL do you mean yellow letter? I think that is the advance request for evidence or N-14 request for information for naturaliztion applicants. Is that what you mean?

Hey I had the same thing happen to me, but when i went for my interview the immigration officer didnt ask me about those forms he only said that my case would take a little longer because of DoD checks, its been a month since my interview and i still have not heard anything from immigration. I dont know if it is possible for you to go back to your base and see if the personel office would sign those two forms it might help speed up the process. Its worth a shot. I was not applying based on military experience either however i did have a general discharge, Ive been in the country since i was 4 now im 32 so well see what happens ive been out of the service for 10 years.

Today I received a response from personnel records:
"Thank you for contacting the National Personnel Records Center. Thank you for contacting the National Personnel Records Center. We have returned the enclosed N-426 Request for Certification of Military or Naval Service without action. The Department of Homeland Security policy does not allow us to release a completed N-426 directly to member.
Upon receipt of the completed form reflecting the requested information, we will make every attempt to verify Military Service.
If you have questions [....]"

I still have not got a response either from USCIS and my interview was passed October 19 I will keep you posted as to when i have more information. When was your interview? At least for you i think you will not have to go to the interview and wait anymore! you will go to the interview and get a decision

Good, for you, I talked to an immigration attorney and he said there was no reason for them to ask for those two forms from the military if i was not applying based on military time. He said it was just a way for immigration to slow me down. I made an infopass appointment for January 18 I have applied for an I-131 because my family is in another country and losing patience with this. Good luck to you and i hope for the best in your case!

Ok, I promised a follow-up. I went to my interview today, and everything went very smooth. IO didn't seem to care about those two forms, only proof that I was legally separated from the army and that I didn't have a OTH discharge. I've done some research about this, and an ELS doesn't legally bar you from US citizenship, because it's a legal uncharacterized military separation (from what I understand). I gave him a copy of my DD-214, he verified it, asked me a couple of questions about it, recommended that I try the air force next time, and jumped to the other sections of the N400. I was recommended for approval, handed oath letter, and took the oath a couple of hours later. Your attorney was correct

AT my infopass appointment i was right away reffered to the Military officer, he had no recolection of my application and was doubting me at first i showed him all my paperwork and he apoligized for the mix up and confusion the original officer who did my case approved my application right away and said he would send me an oath letter notice, he even called me on my cell phone to make sure he had the right address! I hate immigration!
