  • Interview passed. No oath since 1 year.

    Hi everyone,

My father passed his N400 interview in September 2021 (DC field office). Field officer told him he has passed the interview but his finger prints didn't work so he has to send police clearance certificates from all the places in the US where he lived for the last 5 years. Once those are received, he'll be sent the oath ceremony invitation. My dad sent the police clearance certificates immidiately. After a month, USCIS confirmed receipt of the certificates. Its been almost 1 year now since the interview and the USCIS hasn't scheduled an interview. Case status says an officer is reviewing your case. Timeline shows 9 months. When we reach out to USCIS, they say you should just wait. We spoke with a few immigration lawyers, all of whom said they can't help since there hasn't been a decision yet. Thjs is very frustrating for our family. Has anyone else had a similar experience? Would highly appreciate if you could share your stories and outcomes. Thank you.

I've never been in this situation and I feel for your father and your family! From what I understand, things you can look into are contacting your senators or the USCIS ombudsman. If you want to take the legal route, a lawyer might be able to help advance the case with a writ of mandamus. I can't really vouch for any of these methods because I never had to try them, nor do I personally know anyone who did... Good luck!
The above is my personal opinion and not legal advice.

Unfortunately, all you have to do is wait. Alternatively, try to find another lawyer who can sue, but I wouldn't recommend doing that.
