  • Decision. Not given after citizenship interview

    Hi everyone,
I had my citizenship test. The immigration officer kept saying that I was taking short cut as I applied through marriage based. I just took the documents listed in my interview letter (my passport, marriage certificate, my wife's naturalization certificate, and my permanent green card). I didn't take any other supporting documents like I had done during my green card interview. The officer asked a lot of questions and I was able to convince her that our marriage is legitimate and I passed the test as well.

In the end, she said that I moved into Washington 1 month before I submitted my application and the requirement is to be resident for 3 months before submitting application for naturalization. She asked me why I was in a rush and I replied that at the time my temporary physical green card was expired and was extended for a few additional months by a letter by USCIC and I already had started working in a top aerospace company. I was worried that I might not receive my permanent green card and I might lose my job as things would get complicated without any proper documentation to show that I could legally work. The officer looked convinced with my answer but she did not make any decision and told me to wait for 1 month for a letter on the decision.

Has anyone been in the same situation and does anyone know if there is a chance for this application to be approved?

Nothing to add but just wanted to say i'm really sorry that you had to go through this situation!! Sounds like you got a really bad officer!! But how you answered the questions looks great and makes perfect sense to this stranger!! So i'll be sending over lots of lucky vibes for you to get your oath invitation.

If rejected it might be worth speaking to an immigration attorney as I believe you definitely can appeal the decision. If the denial is due to not waiting the full 3 months then I would reapply once you hit that mark!

Forgot to add that if they ask why you want it so quickly again another reason you can give is there are important elections coming up and I want to be fully part of this country and be a good citizen and take part in them!

I am sorry you went thru this with the IO. However, please keep in mind....USCIS officers can and may go back and question your marriage to make sure it was bona fide. One should not take any chances and always take all the documentations with them, even if they have 10 year GC and interview is for N-400 (marriage based). I realize, in your case, this is now behind you. I hope you get your approval letter soon. BTW, your reason for wanting to get citizenship quickly was a very valid one. All the best.
