  • Apply for Citizenship after get the Conditional Green Card

    Hello Everyone.
I dont know if someone can help me or had the same situation before, but:

I got my conditional Green Card based on Marriage in January 2021 and I will fill the I-751, Petition to Remove Conditions on Residence in couple days. My question is: Could I apply for my Citizenship after 3 years married with an American Citizen and after 3 years of my Green Card issued date (it's supposed to be in January 2024) even if I don't have my 10 years Green Card Definitive? I asked because I saw that the procces to aprove the I-751 in NY area is around 18 Months, and If it's delay as I saw my plan is apply for a citizenship when I have a chance.

May someone tell me or know about it?

    Thank you in advance.

Yes, you can file N-400 when eligible even if I-751 is pending. Note that you can file 90 days before being a permanent resident for 3 years (so some time in October 2023), if you will have been married for at least 3 years and your spouse will have been a US citizen for at least 3 years on the date of filing.

This is my personal opinion and is not to be construed as legal advice.
