  • Citizenship / Tax Returns Question

    Hi, All,

So my wife is now eligible for Citizenship (3 yrs of GC + 3 yrs marriage with USC).

I was reading the forms/checklist and had a question.

    1. Do I have to order IRS transcripts for past 3 years before I send her application in ? Or will the Tax return documents from Turbotax.com do when sending the application form ?

Btw, how long is it taking in the San Jose /Santa Clara county for the entire process (application-->interview--->oath) ?

    Thanks,
    KKBoy

    Hey
My suggestion is to call IRS and get the transcript before you send it out. I just sent them the copies from my tax return and i got a yellow letter saying i will have to bring them transcript for the past 3 years for my interview.

I guess you may use IRS Form 4506-T ... Just type in "1040" on #6, check mark on "6A", and on #9, you can request up to 4 tax periods, ex. "12/31/2009", "12/31/2008" etc & have it mailed to the appropriate address.

If you want an expedited procedure, you may go to the IRS on Downtown San Jose on 55 S. Market St., I think it is near the Fairmont Plaza Hotel & Greyhound Station. My Dad went there last year & only took about 10 minutes to obtain a transcript.

By the way, I have a question regarding the 3-yr Green Card/3-yr Marriage to USC eligibility for Naturalization. I am a Legal Permanent Resident now married to a US Citizen BUT I didn't obtained my Green Card thru marriage, I obtained it thru my parent's petition. So down the road, it is true that I would be eligible for Naturalization (1.) after 3-yrs as Green Card holder (meeting all eligibilities) AND (2.) be married for atleast 3 years with my US Citizen spouse? If you are in the same situation, what document evidence did you sent with your N-400 Application under this eligibility?

Thanks for any inputs! Good luck to you as well.
