  • question

    my green card was issued March 2006. I went back to China in September 2010 and stayed there for four months. I came back to US in January. it will be 5 years till next month. but i have to visit my parents again for another 5 months. and come back to US in Aug. I wonder if i am eligible to appy for citizenship in AUg. 2011? Do i need to apply for citizenship immdiately right after 5 years which means i must apply for in March 2011?
    I appreciate if someone is able to answer this question. Thanks

    5-year permanent residency is the minimum requirement. It does not mean you have to apply at the end of the 5th year. The 5-year rule just determines the earliest date you can apply.

        question

        one more question. If i apply for citizenship when i come back to USA in Aug, will immigrant office count my absence days (from March 2011 to Aug.2011) even i have got America card for 5 years (from March 2006 to March 2011)?

          I am not an immigration lawyer, but as far as I know, since you have no trips that lasted longer than 6 months, you should be OK. Be sure not to leave the country for more than 6 months since this breaks the continuous residence requirements and could also jeopardize your green card status. Also include all your travel information during the last 5 years when you fill out your N400 form.

                Yes, one trip should not last longer than 6 months. Please refer to https://www.immihelp.com/retain-greencard-useful-tips/ for "continuous residence" requirements.
