My wife, 34, was born abroad and came her at age 4 around 1980. She was abandoned by her biological father shortly after. My wife's mother legally divorced him and remarried a US born citizen, who legally adopted my wife at age 14. Before my wife turned 18 her mother was naturalized. From my understanding of the immigration Laws that are in effect for someone my wife's age, for her to be an automatic citizen either both biological parents she came here with need to have been naturlized, or if they legally divorce the one who has legal custody needs to have naturalized, before she is 18.
Now, my wife's biological father, who she has not seen or heard from since she was around 5 lost all his legal rights and custody when she was adopted. Her mother, her only legal guardian and parent of the two after the divorce and adoption was naturalized before my wife's 18th birthday. Why was she denied a US Passport?
The govt claimed she did not show proof her mother had sole legal custody after the divorce , but she's been legally adopted in the state of FL and her biological father had all his rights and custody completely removed when she was 14. Her adoption could never have taken place if her biological father was not legally removed in every way from her life. What exactly do they want to see? I don't understand what they want her to show them. She has the original divorce decree, her parents new marriage license and the FL state issued birth certificate showing her mother and legally adopted father. What else are they expecting her to show?
