  • N-14. W2 docs. How long does this take?

    I have a question regarding N-14. I got N-14 right after the interview. My interview was last May 3, 2011 in USCIS-Santa Ana CA location . I passed the test but the IO told me I have to send/mail my 2005 W2 from my old company who petitioned me. Since the N400 application only asks to list employment the past 5 years, I only wrote down the latest company I worked from Jan 2006-present. The IO asked me the previous ones starting from petitioning company and she wrote these down on my application Since she said this is an employment based petition/application, she needs my 2005 W2 from petition company where I got my greencard on Aug 2004. I left that company on June 2005. She said they want to see proof that I was still in that company after I got my Greencard. She said if in case I don't find my 2005 W2, I can request a Wage and Income Transcript from IRS. The N-14 stated submit original docs or certified copy.

    On May 12, I submitted the original 2005 W2 and also the faxed copy of Wage and Income Transcript I obtained from IRS. I received the delivery receipt from the post office confirming they received the documents on May 16.

    How long does it usually take from the time you send in docs to USCIS before you get a reply from them? I’ve been checking my status online and it is still on the “Interview and testing” phase which hasn’t moved since I submitted docs. It has been 2 months now since I submitted the N-14 required docs. I checked current processing lead times as Santa Ana Office for N-400 and it shows 5.2 months. They first received my N400 application or my receipt date is Jan 31, which is now over the 5 months mark. Is this normal? I’m worried that there might be some problems. I hope I can get oath letter soon and I won’t be denied. Should I start calling USCIS or get a lawyer?

    05/03/11 - Interview; passed US civic test but given N-14 - requesting 2005 W2 or Income and Wage Transcript
    05/13/11 - mailed n-14 requested doc 2005 W2 and IRS faxed copy of Income and Wage Transcript
    05/16/11 - USCIS (Santa Ana, CA) - delivery receipt or return receipt from post office showed received on this date by USCIS Santa Ana mailroom

    Hi greenjin
    Hiring a lawyer it's a waste of money since the economy is not good, i mean unless you have extra cash. Your case is not that complicated compare to so many other cases, try to take an infor pass or write a letter to the IO and hopefully it might work.

      Relax; it is just part of the process! I have been through the same thing: N-14, and it took about 52 days before I got my Oath taking! if you are worried to much; call USCIS for to schedule a free Infopass where to meet the Immigration Officer in person in one of your local office to make sure they got your documents! If you are going for Infopass, take all your documents with you including the post office receipt and delivery confirmation of the requested documents. Good luck, I believe everything is fine!
