  • Denied N-400 due to voting

    April last year I was informed by an employee of our local courthouse that i can register and vote even as a Green Card holder. While filling the voters registrations form i again asked her if that was ok, and she said yes ! I voted on kast years election.
    I recently applied for my citizenship and got denied due to Lack of Good Moral ( voting ).
    Please help so confuse if i shld appeal my case . Also called the INS help line and they said i cant apply till 2016!
    Needing your urgent reply.

    I would suggest to ask an immigration lawyer about this. Do you still have contact to the local courthouse employee who gave you this wrong information? There might be a way to resolve this but definitely consult with an immigration lawyer.

      My Dear Friend,
      You are lucky that they did not issue you a NOTICE TO APPEAR
      at an immigration court
      USCIS takes Voting, or False Claim to US Citizenship very seriously.
      You should try talking to a competent lawyer or take your losses,
      and be thankful they they are willing to let
      you apply at a later date.

        yes.she still works there. And a friend of mine who was there with me at the courthouse when the lady informed me that i can regoster and vote is a friend of hers too.

          Definitely seek help from an immigration lawyer. He/She may advise you which further steps to take.

            When you sign a voter registration form, it clearly asks you if you're a US citizen or not. It's clearly written on the form that only citizens can vote. How did you miss that? You should have taken the time to read the form rather than signing it in excitement. You're an adult, you're responsible for your own actions. If someone tells you to jump off a cliff, you obviously use your basic judgement. You should have done the same when you were signing the form.

              Well, the bad advice came from a court employee, not from an x person, so I would not be that harsh, everybody is human. I would suggest to consult an immigration lawyer regarding this issue.

                even court employees are humans who can make mistakes. it's the person's responsibility to make sure they read what they're signing. I understand the excitement, but still. it's better to sign a document after reading it.

                  Agreed! Forum member wcommare made a mistake and is seeking help now. So he/she should speak to an immigration lawyer to sort this out. There might be hopefully some remedy.

                    Moter Voter

                    The problem is called Motor Voter, the Motor Voter act of 1993, my Fiance is from the Philippines, she has been here for 20 years, she became a Permanent Resident in 2000, Three years later she fell victim to this issue that law makers are ignoring, there is a problem with this act and it is getting people into trouble. She went to our local DMV in 2003 to get a State ID, she showed Two forms of identification, one being her Green card, she then proceeded to get her State ID, during the process the State DMV employee asked her if she would like to register to vote, he knew she was not a citizen because of the Green card, but it is the law for them to ask you, Citizen or not, it's entrapment, if your not a citizen and you say yes, they are not allowed to say anything, they watch you sign your way into trouble. She said sure, it must be OK because this Government employee is asking me, a form that was already completed was pushed in front of her, all she had to do was sign it, she was not asked to read it. People will say how did she not see where it said that you declare that your a citizen of the United States, this form was already completed, she did not have to fill anything in, if she did have to fill it out she would have seen that part while she was working her way down the form, I say again all it required was a signature. In 2004 she voted for the President and Three years later she applid for Citizenship and told the truth about voting, in her Interview she was also asked have you ever voted, she said yes. The next thing that happened is her citizenship was denied, she sent in form N336 and it took a year before we heard back on that, she told what happened, she gave proof of a problem at the DMV, she gave proof of other cases just like hers, she told them she made a mistake, she listened to what was asked of her at the DMV and they still denied her. Now she has been put in removal proceedings, they want to deport her for making a mistake and voting one time, seven years ago. She knows now that she made a mistake, the keyword is MISTAKE, but Immigration does not care about how it came about, they just care that she voted as a non citizen. To deport someone for making a mistake one time is an extreme, she voted, she did not Murder anybody, Immigration has arrested people for this, actually put them in handcuffs and chains for voting, to me this is insane. She has another court date coming up on Dec 13th and we do not have an attorney, we cannot afford the 20,000 dollars. If there is anyone out there who does not believe how this can happen, just look it up, there are attorney websites that have articles written about this problem, just go to Google and type in, non citizens lured into voting the motor voter deportation cross fire, or citizenship in sight but then she voted, or motor voter laws, a potential trap for non citizens. Look these up and you will see that what happened to my fiance is happening all over the country, and no one is doing anything about it. Please do not reply back with negative comments, I do not see how you could after reading the websites that I mentioned.

                      This is indeed a big problem. Did your fiancee try to contact the congressman of her district? She might get some help from there.

                            I'll advise you one more time, and then I'll leave this thread.

                            Don't apply for Naturalization. Don't hire an attorney to help him pay off his student loans, because that's all the retainer will buy you for this kind of problem.

                            As things stand, you have Permanent Resident status. It's better than going through the Federal court appeal process to keep from being deported when you can no longer afford to buy legal representation.
