  • Really need HELP getting naturalization papers!

    My husband and his family immigrated here from Germany in 1958. There were 3 juveniles that were supposedly given citizenship when the moither got hers some years later. Their names were on the back of her citizenship forms. Now, the 3 of them are trying to file for Soc. Sec. and are being told they need citizenship papers. Their mother was never notified that they needed to file for that when they turned 18 or 21, whatever the age was back then. The 2 twin brothers, 1 of which is my husband, are now trying to get them by filing n400. It is a nightmare. The one brothers was supposedly accepted for processing but he never got a receipt. It has been nearly 6 mos. and nothing. My husband served in the US Army from `66 to `69 and it says on his discharge papers American Citizen. We don`t know what to do anymore. They have worked all their lives, been excellent citizens, never accepted handouts and this is the way they are being treated by their gov. Is there anyone out there that can help. I have tried everything as have they and they are still being treated badly by USCIS. In addition, all family documents have disappeared since their mom died in 2001.

    Was your husband ever issued a US passport? If yes, that would be a satisfactory document of citizenship.

    If he never had a US passport and also has no other proof of citizenship, I think applying for N-400 does not apply since based on the lost document (i.e., his mother's certificate) he is already a US citizen if he was under 18 when his mother got naturalized. Instead of N-400, there could be a way to apply for N-600, Application for Certificate of Citizenship. I would suggest to consult an immigration lawyer.

      OOps. My mistake. They are both trying to apply for n600. Neither of them has ever had a passport. His brother`s n600 was accepted by uscis but he never received a receipt that it is actually being processed. It has been 6 months so far. My husband can`t even get anyone in uscis office to do anything for him. They said the last time he was there that they had to do a background check on his mother. They keep wanting papers and info that nobody in the family has anymore. We don`t know what to do. Trying to work with Rep. Paulsons office in Mn. to try to get something done. Thanks for replying.

          Thanks for the help. I also took the chance to send for my husband`s Army record from enlistment to the end as he must have had to supply some form of citizenship proof to join. Maybe that will provide us with something.

            That's a good idea. Army discharge papers do in general not count as proof of citizenship but if they could produce some additional citizenship documentation from the time when he first enlisted that could be of great help.
