  • Citizenship without husband !

    Hi , I came to USA legally in 1999 , married a US citizen in 2003 ,I'm a green card holder since January 2006 , my husband left me and disappeared for over 6 years couldn't locate him ,no contact and no divorce is filed yet . I file my taxes as ''married but filing separately'' . I have no idea on how he files his taxes but I know my income is much higher than his and I always end up by paying , I heard he declared bankruptcy and lost his house . I now want to apply for my citizenship and I don't know if I can do it without him , is his presence or his information are a must in the process ? Are they going to ask me about my marriage and to prove that we live together and we don't ? should I apply for divorce first ? I do not need anything from him , we have no assets no children , I just need to go on with my life and fix my situation. Please advise your suggestions.

    His presence is not required and you will be filing based on the 5-year residency rule. However, you would need personal information for the N400 form about his SSN and his current address, etc. I believe it would complicate things. If I were you I would first divorce him and then file for N400 but that's just my personal opinion. If you are unsure, consult with an immigration attorney. I am pretty sure that they have encountered similar cases to yours and they will give you some good advice. Best of luck!

      Thank you for the advice , I think after what I read about similar cases to mine, I should file for divorce first then apply for my citizenship under the 5 years of residency .
