  • Moved but did not file I-865

(1)I moved two years back from Midwest to West coast and did not realize that I needed to file I-865. (We did file Ar-11 for my parents though). I had sponsored my parents for GC Cards about 4 years ago . Next Year they will be eligible to file citizenship . Can I file I-865 Now ? Is that going to cause problem with their citizenship application ?

    (2) My parents will be eligible to file in May 2012 (They Got GC in Aug 2007). I read that you have to be resident of the state for last 3 months where you file from ? How do they prove that they are living with me when they file ? Is the state ID Card with address good enough

    (3) They wanted to visit my brother for 3-4 weeks next year . Would it be a problem with the requirement of 3 year continues residence before filing .. if they visit in Feb or March of next year ?

    Any help is greatly appreciated

If you have ever submitted a Form I-864 to financially sponsor another person who then became a permanent resident, you have to notify the USCIS of any change of address within 30 days after your move. You do this by filing a Form I-865. I would suggest you get in touch with the USCIS at 1-800-375-5283
