  • N400 Question re: Stepson and Child Support Payment

    Hello,

Thank you in advance for helping me with the below questions.

I am a permanent resident through work sponsorship since 2005 and am ready to apply for the U.S. citizenship. In 2010, I married a U.S. citizen. My husband is a one-time divorcee with a child. His son (my stepson) lives with his mom. My questions are:

    1. On Page 6 of the Form 400, Part 9, Question B: Provide the Following Information About All Your Sons and Daughters: do I have to list my stepson as my child? I read M476 publication, and looks like the answer to this question is yes I have to include him on my application, but I just wanted to double check with the experts here.

    2. If the answer is yes on Q. #1, do I have to provide the child support evident even though I am not responsible for my husband's child support payments (said so in his divorce decree)?

Thank you again for your time.
    Kay

About number 1, I am pretty sure that the answer is yes. Your step-daughters and step-sons are listed as your children.

About number 2, I am not that sure, but I would lean towards yes on that question as well. You might want to ask an immigration lawyer for clarification on that. Or maybe even the USCIS help line could provide an answer.
