    Hi,

    An Indian friend of mine along-with his Indian wife is in USA since Oct-2011 on six months company assignment on L1 / L2 Visa. The were blessed with a Baby Boy in Jan-2012 while still in USA. So as per US laws the Child is now a US Citizen and they have applied for his US passport also. In April-2012 they have to return to India, as their company assignment will be over. They don't want the Indian Citizenship for their new born, as they want their child to be US Citizen only keeping in mind the future prospects of their child.

    Now they also want to settle in US on the basis of being the parents of a US Citizen. As their child is US Citizen. Parents have valid Indian Passport.

    They had visited the US before, on six months company assignment on L1 / L2 Visa. Wife is on dependent visa. This is their second visit to US.

    What are their chances for settling in US on the basis of their child US citizenship basis.

    As far as I know, having a US citizen child does not increase your chance for settlement in the US until the child reaches 21. Once the child is 21 years old, he/she can petition for a greencard for his/her parents. So right now, the parents are more or less on their own and can try to find a job in the US on an H-1 visa that may lead to a company-sponsored greencard.

      There are no benefits for parents of US citizens till the child turns 21. Only then the son/daughter can file for their parents.
