  • N-400 Question - Help!

    My neighbor is a Permanent Resident and is applying for her US citizenship this year. While filling out the N-400, we had some trouble with Part 9 (Information about your children). She has a son who is illegally in the US. He entered the country when he was 13 and is 21 now. He has an A-number since an application for his green card was filed a few years ago (I-130) by his mother. How should she fill out this part of the form to avoid any problems? Can she write his name, current address (which is in the US) and A-number without any problems? Can she avoid mentioning him at all? What should she do? Please help, she is very nervous about this and does not want it to affect her citizenship process. Thank you so much!

    She cannot avoid mentioning him. All information needs to be disclosed truthfully to the USCIS. On the N-400 form, by signing it you say that everything on the form is true. Also, during the interview, she will be under oath and the officer will go over her N-400 form line-by-line. So yes, she needs to write the name, A-number and address of her son on the N-400. She will be in trouble with great probability if she does not discloses everything truthfully. Remember, the rule is: Never lie to USCIS!

      Yes. I agree with NWCTZN. Never hide anything from the USCIS. Be transparent in all your disclosures.

        Thank you so much for your responses. I'll tell her to write everything as it is. Do you think there is any possibility of USCIS finding/deporting her son when they process her application?
