N400 Questions

  • N400 Questions

    I'm filling out N400 form and have some questions:

    1. Part 6 A & B: I am eligible based on the 3-year marriage criteria. Do I still need to list all the addresses lived and companies worked for the past 5 years? I came to America in 2009.

    2. Part 10 A5 Do you own any Federal, State, or local taxes that overdue?
    We are making payment for taxes owned due to a mistake made on 2008 tax return. We have the payment arrangement letter from IRS. Does this count as overdue?

    1. You list only addresses and employment info and travel info from the last 3 years since you became a legal permanent resident. Since you are applying based on 3-year marriage, read every 5 years on the N-400 form as 3 years.

    2. Looks like you are fine with this one but I am not 100% sure about this. I would ask an immigration attorney about a second opinion and when filing for the N-400, I would include the payment arrangement letter besides the 3-year official tax return transcripts.

      Thank you very much nwctzn for your help! As for the 2nd question, I do not have an immigration attorney to ask...

      You mentioned 3-year official tax return transcripts. I saw on M-477 Document Checklist, under item 4 Bring documents referring to you and your spouse, there are three options:
      a. Tax returns, bank accounts, leases, mortgages, or birth certification of children; or
      b. IRS-certified copies of the income tax forms that you both filed for the past 3 years; or
      c. An IRS tax return transcript for the last 3 years.

      It looks like tax returns will also do. Or is return transcript a better option even though there are three options listed?

      I am going to request the tax return transcripts. Would like to know if I can mail N400 with tax returns before I receive the return transcripts. Or better wait until I receive them?

        I think they want official documents, not copies of your filed tax returns. You could send in option (a) bank accounts, leases, mortgages, or birth certification of children.

        Those seem to be the easiest documents to send in. Meanwhile, you can order the tax return transcripts from the IRS and have them with you during the interview in case the officer asks for them.

          Thank you! I just ordered 3 years tax return transcripts from IRS website. Hope they will get here by the time I am ready to mail the N-400. This will be the easiest way to do it.

            One more question:

            At the end of the N-400 form, there is a Printed Name of Applicant and Complete Signature of Applicant section just below Part 14 Oath of Allegiance. Is this part of Part 14, which does not need to complete, or a separate section that needs to be filled out? Do we need to sign the N-400 form?

              Do not sign Part 13 or 14.

              You sign only Part 11.
