  • child passport: immigration act 322

    Hi All,

I was born in the US on 26 December 1984 and am a US citizen.

I currenly live in Hong Kong with my husband and 2 kids aged 5 years and 10 months. My husband is not a US citizen.

My Father (my kid's grandparent) was a US citizen and He lived and worked in the USA for around 15 years. He then moved out of the USA in late 1980s and I also moved out of the USA with him at an age of around 4. My Father then passed away in 1996.

I want to apply for USA Passports for my children under Immigration Act 322 as I am US citizen and my father (my kid's grandparent) was a US citizen and lived in the USA for a period of more than 10 years.

I have few queries regarding the application and the documentary evidence that would be required for the application. Please kindly have a look the details below and kindly let me know about the information.

    1. I have the US passport of my father and the date of expiry was 23 Sep 1997. Please let me know if the copies of this passport (or the original passport) will suffice as a proof of my father's US citizenship?

    2. Please let me know about what evidence shall I provide in order to prove that my father lived & worked in the USA for a period of more than 5 years? Would any reference letter, stating the period of emplyement, from his employer in the USA will suffice as a proof? Please kindly let me know.

    3. I lost my passport and applied for a new passport in the US consulate outside USA in 2002. I had to submited my US birth certificate and my father's passport for this. After they came to know about my father's death, they put a "Cancelled" stamp on the passport in 2002. I have this original passport with me. Please let me know if this passport can suffice as a proof of my father's US citizenship. Please note that my father was a US citizen even until the time of his death in 1996 and this stamp was put in 2002 after his death. do you think they can object about the passport having "cancelled" stamp on it? there is no date given for this cancelled stamp. they also punched two holes in the first 2 pages, probably in ordert for the pasport not to be misused. if they object to this now , do I have an alternative? can the passport number of my father be sufficient to prove he was a US citizen. The problem is that I dont have any other document at hand. This is the old passport and i think its not machine readable. But i think the immigration guys should still have some computer records that my father was a US citizen and remained so until his death? please help

I have read the relevant information available online for the Immigration Act 322 and for the N-600 application. I would really appreciate any help here.

    Thanks a lot
    Best Regards,

    RS
