  • Failed to pass the test

    I have 2 questions please.

1- I failed to pass the civic test the first time and I know that I will have a second chance within 30 to 90 days from the date of my first interview. I won't be in the US between this time, what should I do?

2- What if my greencard expires before the next interview? If I show my expired greencard at the interview would it still be accepted or do I need to apply for a new one?
If yes how long does it take to receive the new greencard?

    Thanks a lot

1- Make sure someone is checking your mail since you do not want to miss your appointment letter from the USCIS. If you cannot attend, you need to inform them and reschedule. If you simply do not show up, they can consider that you abandoned your case in which case you need to restart the whole process losing both time and money since you would need to pay the fees again. You could try scheduling an infopass appointment at your local USCIS office before you leave and let them know. They might schedule your appointment then accordingly.

2- When you applied for N-400, did your greencard have at least 6 month of validity left at that time? If yes, you should be OK. If not, you might need a new one. However, I read of cases where people where fine with expired cards. It looks like it kind of depends on your officer. One thing to note though: Make sure you come back to the US before your card expires.

Note: When you go to your appointment after you return form your trip, you need to update your travel information on your N-400 with the officer. Remember, they need all travel information until your oath ceremony, so make sure that they have always up-to-date travel information.
