  • Any problems with a gap in employment

Please help me with my question

I worked for company A (sponsor) from 2002-2006 but I had to take medical leave due to a high risk pregnancy and subsequent miscarriage. The company filled all the i-140 for me. I had to stop working for about 9 months. On July 2007 my i-485 was filed and they rehired me. My green card was approved (eb3 245i recipient) on September 2007. I was laid off on September 2008.

Is this gap of employment a problem for USCIS? Please advise

    Thanks

Should NOT be, for the reasons you specify. The medical leave is AOK. And you were fired, so it is NOT your problem - ie, you didn't accept the job with the company under an EB category, just to leave as soon as you got your greencard. Believe it or not, they firing you actually helps you

The will, however, ask you about your sources of income - in other words, who's paying for your living costs right now.

Oh I have been working since. The gap of employment was just before AOS. Afterwards I always worked.
