My girlfriend and I are getting married at the court house and I am not sure what to expect especially regarding the name change. I plan on filing both the I-130 and I-485 immediately after we get married at courthouse.
1. She is here on a J1 Visa ( no 2 yr requirement ) which expires mid July, but her flight back is scheduled for August as she has 30 days after expiration to be compliant with the visa.
2. Does it make more sense to not change the name? I dont want any issues arising.
3. So if she changes her name with the marriage license, what happens to her current J1, foreign passport, other forms etc?
4. Does she risk anything by flying back in August with her original plans even though she got married?
5. Can she come back with 90 day visa waiver program if she is married?
