  • J1 home-resident policy waiver

    Hi,

I am an Indian (25) with 4 years of experience as a Software Developer. I got an offer from one of the companies in the USA and they have applied for H1B.
Because H1B is taking time this year and then there is a lottery system, they are planning to apply for J1 as well (I will be able to work there for 18 months over there and meanwhile they will keep applying for H1B).

My concern is regarding getting home-residency condition waived off. I have heard it's a long shot with Indians. I want to check how easy or difficult it is.

And has anyone else gone through the similar situation (went there to work there and then tried to get the waiver)?

    Thanks in advance!

Cultural exchange workers are typically not subject to the 2yr home residence requirement

Do you really want to set yourself up to be exploited by someone willing to abuse the cultural exchange worker program to obtain cheap foreign labor?

Thanks for your reply. I don't want to apply for J1 either- although, being paid less is not the reason (I am being paid appropriately but thanks for your concern).
I don't want to apply because that's the visa's main intention.
