  • Waiver after studying in public university

    My wife is currently finishing her PhD in a public university in the United States. We chose the J1-J2 visa because it was the only one that would allow me to work in the States. However, we would like to stay here if we are able to find work, so we are looking forward to get the waiver of the two-year home-country physical presence requirement.
    Now, one of the requirements for the waiver is not to have received funds from a Government Agency. Specifically it says that one is subject to that requirement if one "participated in a program funded in whole or in part by a U.S. government agency"
    Our question is: can a public university be considered a Government Agency? Is there a way to elude this? We did not receive funds from our home country (Colombia).
