  • Need advice on "home country" requirement

Hi, I wanted to get clarity on my ability to apply for an L1 visa. I'm an Indian citizen, and I was in the US on two occasions for an internship. This means I'm subjected to the 212(e) 2 year "home country" requirement. I applied for this internship in the US when I was in university in Canada (which is where I'm currently located). My understanding of the "home country" requirement is either my country of citizenship or country of permanent residency at the time I began J Exchange Visitor Program. My DS-2019 in box 1 says that my country of permanent residence is Canada, and I've been in Canada for about 4 years since my internship on the J1 visa in the US, fulfilling the 2 year "home country" requirement. I want to make sure I'm interpreting the law correctly and I take the right steps to be eligible for applying for the L1 visa.
