  • J1 - B?

    Hey there,

First of all thank you so much for this wonderful service!

I'm confused and would love any good, solid advice....
Situation: Arrived in US on 14th August 2004 for a Student Exchange Programme. Which I have conducted. The date on my I-94 card is D/S (Duration Of Stay) As I understand that, this is 30 days after my programme finishes..(i.e June 5th)

I have been working on a movie with some friends and we are hoping to film it this summer, and I obviously want to stay in the country with them to do this. (This would be non-paid work and entirely voluntarily)

    1) Do I have to apply for an extension? Would the visa peeps mind that
I had stayed past the "D/S" but a new school year hadn't started yet.

    2) If I did get an extension, would it be a B2 (Visitor for Pleasure)?

    3) The part i'm most concerned about..if i understand it correctly (which i probably don't!) if i apply for a visa extension now and it gets rejected...i have to leave the country immediately before i've even finished my student programme? It seems ludicrous but i can't find anything to refute it.

    4) Finally, I'd obviously need to change my plane ticket and I hear that helps to back up your application. Do i just change it and gamble that hopefully i'll be able to stay? Or do i wait until after recieving acceptance/rejection and not having having it changed twice?

Thank you so much for your time in advance,
    Zack

OK...to answer my own question if anyone is having the same issue....

I've been told, as a British national, to not apply for a B2 visa but simply to go to Canada, and return over the border on a VWP (Visa Waiver Programme.) This will give me 3 months legally as a visitor to the US.

      Hope that helps someone,
      Zack
