h1 to j1 pending change of status > 3 mo, should I travel back home to get it stamped

    hello friends,
    My change of status from h1 to j1 required for starting fellowship in cards is still pending after 3 mo of applying, now the center is confused as to request for evidence, when they haven't sent any mail, even after sending the evidence, it's gonna take more time, god knows how much .

    My question is , should I just go back home to india to get it stamped ? Do I need to withdraw my i-539 application before I leave ? I heard even withdrawing can take long time ? my university is getting eager to give away my spot , which as ya'll know is soo hard to get anyways in cardiology. I have a small scare of visa being rejected in india too ?
    I'm stuck in this tough dilemma. Any suggestions ? Can a lawyer help in anyway ? I filed the COS myself.
