  • I am Canadian/American and want to move family to the US from Canada

I was born in the USA and currently live in Canada, I have lived in Canada for almost 30 years and am a Canadian citizen.
    I have been married for 11 years and have 3 children (11, 8 & 3 years).
My father lives in the USA along with my brother and we were contemplating moving to USA to work for my father.
I looked online and the information is mostly for spouses that live in separate countries.
Is it possible to apply for visas or passports for my family?

Yes, you can follow the direct consular filing process in the US embassy in Canada.

Normally, if you are an US Citizen, who spent some time (the time varies based on being the father or mother of the kids) in the US before or after a certain age or your parents or grandparents did, before leaving the US to live in a different country, in this case, Canada, all your biological/adopted minor kids acquire US Citizen by birth, irrespective of where they're born, even if they were born out of wedlock. There are specific regulations in each case. There are a couple or so forms one of which only needed to have been completed with the local US Embassy where u resided at the time of your children's birth (in this case, Canada) to document your kids birth record and which would have served or serve as their US Birth certificates (not the same kind normally used if they had been born physically in the US, but different forms/documents).

In this case, they would not need to apply for visas as they're already US Citizens by birth, but are eligible to apply for US Passports to enable them travel back and forth to the US. Yes, u can do so at the nearest US Embassy in Canada. You would need to show them (the US Embassy) proof that u are an US citizen in the form of an original US birth certificate, US Passport or any other acceptable document that shows your US Citizenship if you did not complete one of the above documents after the birth of your children. That (your proof of US Citizenship) would also serve as evidence that you were still an US Citizen at the time you gave birth to your kids.

I would advise that you check with your local US Embassy in Canada to help you apply for US Passports for all your children.

Hope the above info helps. Let's know what happens after contacting the local US Embassy in Canada. Good luck.
