Sent in I-751 Sept 24, 2012 with Certificate of Live Birth as one of many supporting documents.
About a month later, we rec'd the I-797 NOA granting my wife an automatic 1 Yr extension of her Conditional Permanent Residency. Now we are waiting for the Biometric appointment. How long does this typically take?
The I-797 receipt also asks that we include the "I-797 along with any documentation we may send and may include, but not limited to the following items" and goes on to list the following
1. Lease of Joint tenancy or joint ownership of assets
2. Joint Mortgage agreement and/or property deed
3. Tax Returns
4. Birth Certificate of any children born from the marriage
5. Joint policies of life, medical, and/or car insurance.
I wonder why these were listed? are they just standard language of this type of I-797?
I ask because we submitted the following -
• Application fee - $590 including Biometrics fee
• Form I-751
• Copy of wife’s Permanent Resident Card (Front & back)
• Copy of both our drivers licenses showing same residential address
• Certificate of Live Birth of our daughter born in 2012
• Representative photographs marking key moments in our married lives from mid 2010 (post initial AOS filing ~April 2010) to the present (Sept 2012)
• 3 Affidavits (2 from family friends and 1 from our pastor)
• Vehicle Registration and loan documentation showing joint purchase and title of our car
• Copy of the “Articles of Organization” of our LLC company
• Copy of the relevant pages of the “Operating Agreement” of our LLC company (to show joint ownership)
• Copy of Life Insurance Trust showing my Term Life Insurance beneficary being my wife as the survivor.
• Copy of 2 bills addressed to the both of us
• Copy of the jointly filed 2011 1040
It seems to me that all the documents listed in the I-797 I reproduced above, had already been submitted in our Sept 2012 filing of the I-751.
Am I missing something? and how long does a typical I-751 application to remove conditional residency take?
