    Hi,

    My fiance was in Mumbai for the visa and they given her paper saying they denied the visa under section 221(g).. but they also wrote that "We will contact you"...

    When i inquired about it.. they replied that They are doing some Administrative process.. once they finished the process they will contact my fiancee..

    I am ready to fly to Mumabi and clear and doubt if they have any about my petition...

    Please advice..

      Sorry.. My question is what should I do?? Wait or get married

        You wait. You were not denied in the strictest sense of the word. Your visa application was simply put under Administrative Review (AR). A variety of things are common in an AR, e.g. background checks, document checks, name checks, etc.

        Don't panic. Don't get married now. The fiancee visa is for you to get married AFTER the visa is issued, not before. If you get married now, you start all over and the K3 or CR1 visa process is not necessarily any shorter.

        I cannot tell you how long the AR will take. It may take anything between 2 weeks to 2 months. Just be patient. You're so close to the end already.

            My fiancee just got an inquiry from mumbai consulate.. They asked questions to neighbors and then went to her house. They also asked her few questions.

            Few questions were like this.. to Neighbours: Do you know this girl?? did she got engaged/married to someone?

            They left and told her that they will contact her via phone or mail within 10 days...

            Any idea?? what could be outcome?? What was the purpose of their visit??

              I have no idea. Perhaps it is their way of conducting background checks on your fiancee. Maybe they want to be doubly sure your fiancee's plan to marry you is legitimate. Perhaps you can call the consulate to find out?

                    212(g) wait for their call

                    My fiancee has the sam situation like you. They told her they will contact her. The last thing they asked before that statement was a resquest for my Tax return from the IRS. The IRS fax it to me then I send it to my fiancee so she can present that to the US consuler in vietnam. It is 3 months now but no word from them....So how long should I wait or what can I do to speed this process???

                        C1D visa Pending status under section 221 (g)

                        Dear Members,

                        I went for the visa interview this morning at mumbai consulate that is June 17th 2008. the interview was good. the Lady consular told me my visa have been approved and that the visa will sent to me. but all of a sudden she asked me to wait and started to look for something in her computer, she kept me waiting for good 5 mins and then handed me a a white form which says VISA placed in pending status per SECTION 221(g) and told me its not denied and that the consulate will call me. and did not mention any reason on the form which she gave me.. Just checked on the OTHER option at the bottom of the form.
                        I need help on this as to how would be the procedure for the same..

                        Now the queston is..

                        1) Is there any problem if my address on passport and my current residential address is different.. ( in case of Background verification check )

                        2) how long does it take for the process.

                          There's some bad advice so I want to correct it. No, you CANNOT get married and apply for an I-130 anymore, nor can you start over with a new I-129F.

                          Sounds more like your "Lady consul[ar]" tried to be nice but found it too hard to do, so she looked into the computer, and Lord and Behold, found something, but didn't bother to ask you a thing further to try and remedy this genuine problem!!!

                          It's a first to hear that consulate would send someone to the neighborhood to verify bona fides of the relationship (investigations aren't cheap, you know). Very unusual!!!

                            sorry may be i did not explain properly.. i have applied for C1D visa coz i have got a job on a Cruise ship and it had nothing to do with my fiance or anybody i will be going alone..
                            and its very rare that C1D visa's go under pending status of Section 221(g).
