Hi! I am now here in Ca, USA as a tourist, came last september. They gave me 2 entries, 2 months each, expiry jan.5, 2013 for my visa. But they gave me 6 months to stay until march 08, 2013. Now, my question is, how can I come back here for my second entry if my visa was expired already? Can I get married here on a tourist visa? Will there be a problem with that? I'm afraid, there will be difficulties with my immigrant petition EB3 with a priority date of oct.2008 on process but not moving! Any concerns would be very much appreciated. Please. Thanks!

When you arrive, what will be your intent?
Are you coming to get married?
If this is your actual intent then you need to file for a fiancé visa which takes approximately 9 months to process.
Honesty is always the best policy, especially with homeland security!
Good luck. Consult an attorney about your fiancé meeting the requirements for her to sponsor you

You should not get married in B2 visa. If you marry with out proper entry then it wont be legalized marriage. so you can apply for fiance visa, then get married and settled down in USA.

Marriage is legal so long as both parties meet the local requirements for marriage. Visa type has nothing to do with legality of the marriage.
On the other hand, marriage in the U.S. while on a B2 visa is viewed with some suspicion, and may require a compelling explanation at the Adjustment interview to explain that entry to the U.S. was without intention of staying or marrying. Most such Adjustments from B2 visas are approved, so long as there is no evidence of fraudulent intent.
