I had refusal worksheet on my interview from US consulate due to my K-1 petition not revalidate and expired.My K-1 petition was filed for me and 2 teenage kids from my US resides fiance.It took one year to get interview but they denied my K-1 visa.
The letter says,
The petition is being returned to Citizenship and Immigration Service and the embassy will take no further action on this case.If you wish to continue to pursue a fiance visa or other immigration visa you must be filed a new petition.
The consulate sent an email a week before the visa date and asked kids documents which i was taken with me.The interview was 20 mints long and i answered all questions very well.He asked why you engaged not married i told all her family in US and so we decided to get engaged here and get married in USA.They did not ask about any of kids documents they asked me to bring on my interview.The officer just asked the kids will go with you and I told yes because I am legal custodial of my kids.
They asked how my fiance and i met.At the end of interview he officer said go get married with her.
Now please tell me what to do.
Does that mean my case denied because the K-1 petition was expired??
I have not asked to provide more evidence or papers to provide.
Now it that good option my fiance come and get married and file a new spouse petition?OR should we work on Fiance visa and ask why i was denied?
Will my case continue if they ask something and i provide it?OR in case of marriage i have to wait for another year to get approved?
What is the best option(pursue Fiance or new Spouse petition) to cut down the previous time and get approved in short time
