  • Question Re: Cosponsors and Traveling on Tourist Visa

    Hello,

I'm looking for some advice. I have seen a lot of conflicting answers about my two questions and am just hoping for some clarification...

Background: I'm a US citizen and my fiance is a Turkish citizen. We are both currently living and working in South Korea. We are hoping to move to America sometime in the fall. He is also applying for jobs in hopes of getting an H1-B Visa, as he's an engineer, but the fiance visa is our back up plan.

Since I have been living and working abroad, I don't have the relevant income in the US to meet the requirements of the Affidavit of Support. My mom will sign on as a co-sponsor and she meets all of the requirements. Are there any problems you can foresee with this? We have savings but it does not meet the amount that we would need on our own. Also, we were trying to time the filing so that I could go home first and find a job to have something to show on the Affidavit of Support.

My second question is would he be able to come visit me on a tourist visa after we have filed the Petition I-129? Could this hurt our chances in any way?

One other side question, what do you think about having an immigration attorney? It's a lot of money that I don't want to spend if I don't have to. Do you think it is necessary or have a lot of you been successful without hiring an attorney?

Any help is greatly appreciated! Thanks!
