  • Confused with Options for Marriage to my Mexican Fiance

My finance lives in Puebla, PB Mexico, we have been engaged since May and now are confused as to which is the easiest, quickest and least expensive option to get married, get her here and get her employed. She is a bit of a workaholic, which is good since I am too. We are both seasoned professionals in the IT field and have never researched this sort of thing before. I don't want to file the i-129F if the better option is to marry in Mexico. There is one other hitch, I am recently divorced in the USA as of March 2013 it became final after a nasty several year battle over custody and finanical matters.

Any Help Or Options would be greatly appreciated.

No matter if you do the K-1 fiancé visa or get married in Mexico and apply for K-3, she will have to apply for work permit after she gets here and it will take about 60-90 days to get the work permit. Also, once here, she has to apply for the green card separately. If you apply direct for green card after getting married in Mexico, it may take month or two longer than the K-3 but she will be authorized to work as of the day she enters the U.S. She will get her SSN in the mail about a week to two after she enters.

I guess the thing is, since neither of us know... Can we marry in Mexico and then return to the USA together over a period of a week or so, or should we marry there, (for her family) and then have the K1 in hand to border cross then get married again in the US? Neither of us enjoy the idea of getting maried and then one of us leaving again back to the US without the other one coming along. Maybe it is a dream that can not be achieved, but that is just another of our concerns.

Thank you so much for your reply LisaAnderson...

Getting married in Mexico after the approval of the K-1 technically invalidates the K-1 if the marriage is a legal marriage. The only other option I see is if she comes here on the K-1, you guys legally marry here and then, once she’s able to travel, go back to Mexico and get married there. It will be at least 2 months after the wedding in the U.S. and the filing of the Adjustment of Status with travel permit application before she’ll be able to travel back to Mexico.
You might want to speak with an immigration attorney.

If you are married then you are not eligible for the fiancé visa. Keep all things clean and correct. Homeland security doesn't play around.
Issues might arise later with withholding information.
The USA has visas for specific purposes and you may use them for your intent only
When you apply and use the visa remember the key! What was your intent!
A judge may ask you this one day
