  • Help Deciding On Going With A K1 or K3 Visa??? Please Help!!

I just got engaged to my boyfriend of six months who lives in Jamaica. We need help deciding if its easier/cheaper to marry there or for him to come on a K1 visa and marry here. I could use all the help I can get. I'm ready for him to get here already so we can start our lives together.

The K-1 Visa process is bit shorter than the process for the immigrant visa once you’ve already married with or without the K-3 visa.

In terms of fees, applying directly for a green card once you’ve already married is definitely cheaper. For this process, you have about $420 in filing fees to USCIS for the I-130, then another $320 to the DOS for the immigrant visa processing at the consulate and finally $165 to get the green card produced after the interview and before you husband enters. He gets the green card in the mail a few weeks after entering the U.S.

If you get married over there and decide to get the k-3 visa, the first two fees are about the same as above. Then once your husband is in the U.S., he has to pay an additional $1070 for the Adjustment of Status application to become a green card holder.

For the K-1, the fee for USCIS for the K-1 application is $340, then about another $320 to the DOS for the K-1 visa processing at the consulate. Then once your fiancé has come to the U.S., he has to pay the $1070 for Adjustment of Status to become a green card holder once you have gotten married.

Also, for the K-1 and the K-3, you have to attend an interview in the U.S. together.
