  • Fiancee left a month later after marriage

    Can someone explain to me - what happen when you marry your fiancée but she decided to leave and terminate the relationship. I have not apply for a green card and it has been almost 7 months since our marriage. I married her 1 month after her arrival to the states. I already file for divorce since she left to another state and prefer to stay there and not work the relationship. Can someone explain me or guide me through what should I do?

    Can she stay here?
    does she have to leave the country once I finalize my divorce?
    Can she adjust status without me?

    She's very ignorant if she thinks she can apply for a green card by marrying someone else or getting status some other way. If you entered on the fiancée visa, you can't adjust status by doing that. So she better leave, or else she'll be out of status and if found by ICE, get deported or if she leaves after being here 6+ months out of status, she will face some immigration bars.

      the rule is very straight on this one, if she does not marry she has no way to adjust her status, but after marriage all she has to do is self petition and prove she entered into the marriage in good faith, you can write to USCIS and explain that she did not but keep emotions out of it, they will flag her and question her a lot about it if and when she tries to apply for green card.
      and you are still on the hook for affidavit of support, divorce does not cancel that.
