    Hey fellow Immis,

    I'm a Canadian married to a US citizen (three years ago in the US). We currently live in Canada with our two children. My husband will be attending university in the states in January 2014 but we'd like to move by December of this year. In April we filed I-130 but have yet to hear back. After doing some research online I read that in order to move to the states sooner (I'm a little unclear to be honest) we needed to file I-129F in order to obtain K-3 status. I know Canadians aren't required to enter the US with a visa AS TRAVELLERS but seeing that we won't be entering as such, but rather, with the intent to LIVE in the US, must we then wait for k-3 status to be obtained or are there any loopholes to help us get around this, as we don't want our family to be separated

    It really doesn't sound like you need to file for k3 as you already married. My understanding is the k3 is for the fiancé visa intending to marry in the country.
    I think you should call USCIS or get in contact with Catholic Church lawyers, they are as knowledgable as immigration lawyers.
