  • Fiance Visa and Currently Married

So I have looked through the discussion forums and haven't found what I was looking for. I'll try and go into as much detail as possible just to get the help I need.

My fiance is currently living in the Philippines with her 2 kids. The problem we are running into is that she is still legally married in the Philippines to her husband even though they have not been living together for the past 2 years. How do I go about getting my fiance and her 2 kids here? I have been told that once she becomes a citizen here in the US, she can apply for a divorce from her husband, but until then we aren't sure. Divorce in the Philippines is essentially against the law and the annulment process takes 7+ years.

Are there any other options that we can take that could get her and her kids here if the fiance visa won't work?

Any help would be greatly appreciated.

Without getting the divorce you can't proceed for fiance visa, because that's the very important one among the required documents. if you are planning to get the citizenship, she has to come in work visa some thing like.. sure it'll take more time for processing.

At the interview the US embassy manila will ask her for a CENOMAR from the Philippine goverment that will show she is married and the K-1 denied same with CR-1. Annullment 100,00PHP and takes maybe 2 years, min. NO easy way out of this. sorry

Thanks for your input - this certainly does put us in a really odd and hard situation. It's unfortunate the law that they have set in the Philippines regarding divorce. I guess we will have to look at another plan. Thank you again!
