  • I134 and documents... help!!

    So last year I was a student and did not meet the poverty guidelines for the I134. However, I now have a full time job well above the 125% line as of this year (Sept). I am submitting a letter from my employer, bank statements, savings bonds, pay stubs, and birth certificate along with my i134.

    Also, I DO have a cosponsor submitting bank statements up to a year back, pay stubs, letter from employer, birth certificate, and proof of home ownership (but no W2/taxes) with their i134.

    If the cosponsor is not submitting W2, do you think its best I leave out my W2 as well? What about including my 2012 tax return if I owed money since I was making so less? Do I have enough evidence to substantiate the i134?

    Include your w-2, you meet the 125%, so maybe no joint sponsor needed, but I guess you are just being cautions.

      For what visa type are you applying? If for an immigrant visa, your petitioner must submit an I-864, Affidavit of Support, with supporting documents.

      For a visitor visa (B2), you are not expected to have a sponsorship package submitted for you, and an I-134 from you is irrelevant, since your income outside the U.S. is not what needs to be proven.

        K1 visa. I134 is the affidavit necessary but I am not sure how much proof they need and how much weight is put on the W-2 and tax forms

          The sponsor must submit a copy of the most recent Federal income tax return, coupled with source income W2 or 1099 forms. An IRS transscript of tax filing history for at least the most recent tax year can be used instead, and without W2 or 1099 forms (which are reported on the transcript).

          Greater weight, however, is on proof of ongoing income, which will be annualized to meet or exceed the income requirements. This will be employment verification, paystubs, bank statements.
