  • Affidavit of Support - Form I-134

    I have 2 questions regarding my K3 application:

    1) Can my company act as sponsor (since I would still work for them after getting the K3)?

    2) If we send in my I-130 and before I have the I-797 I have a chance to apply for an L1, will there be a problem?

    You are not likely to end up processing a K3. Most likely, it will be an immigrant visa (IR-1 or CR-1) and the sponsorship document will be the I-864 (not I-134). The I-864 primary sponsor is your U.S. spouse. But a joint sponsor can be another individual. I doubt that a business can be used as a sponsor for a family-based visa. (but it's probably worth testing).

    An L1 can also be applied for while the I-130 is being processed, but you will have greater benefits from an I-130 immmigrant visa in the long term.

        You won't end up processing a K3 visa because USCIS doesn't forward K3 petitions to the foreign consulate (usually). Both the I-130 and I-129-F are joined and approved together, and the I-130 is moved to the State Department (NVC).

        No matter what you have read about K3 visas, they are very seldom issued anymore.

        If for a spouse, the spouse will get an IR-1 or CR-1 (depending on length of marriage).
