  • The ebassy sent a packet today! Silly after hours question!

    The forms i129F package asked about her family. We disclosed that she has a son only because it was required. She does not have custody of her son. He is not traveling with us. However the embassy included her son on the letter as a "traveling companion".

    The sample DS160 asks how many will be traveling. The answer will be only one.

    Is this any big deal?

    Her son is a student also. He has friends, and family were he lives.

    You have nailed it correctly. USCIS and the NVC assumes that elgiible children listed on the I-129F will be applying for derivative K2 visas, but no follow-through is required for the children.

      Thanx Ray:

      Her medical exam is this Saturday (February 8). We are so close now!

      I am a bit worried that they may question the fact that I do not have a job, or residence in the USA. However I have $20k in savings in the USA, and another $150k in stock investments in the USA. I make over $100k in Singapore, but I am told by two different lawyers that it may not count.

      I also verified again that there is no law that says we must AOS and stay in the USA.

      The interviewer may question our use of they K1 rather than the B2, but I am covered on this one. I learned that it is considered fraud to marry a USC on a B2 if you planned to marry before planing the trip.

        Your gal must have a signed I-134, Affidavit of Support, from you with solid proof of your liquid assets, using a U.S. domicile address, and proof of ongoing income, even if from work abroad. The income from abroad does count if you have proof that you are only working abroad temporarily and report your foreign income on a U.S. tax return.

          My contract is for three years in Singapore. I have about 19 months left. It does say that I will be transferred to California at the end of my contract. I plan to extend here in Singapore, but they do not know that. I can show some healthy US tax returns for the last three years. I think I can do it.
