Applied for K1 Visa and followed away in feeling to get marry, forgetting the facts about the K1 Visa requirements. After 7 months we received RFE (Intent to marry, and other documents). We then already waited for 7 months, decided to go with K1, hiding that fact that we are married, and we submitted the Intent to marry letter to USCIS.
Now after 16 months still the application is under process, We have raised a complaint at USCIS, then INFOPASS, and then AMBUDSMAN, but no success yet.
My US citizen fiancée (actually spouse) is thinking of getting divoce or appling for IR-1 visa (confused).
My Questions:
1) is divorce needed for fiance (actually spouse) relation.
2)Can I prove that we are married in foreign country so a divorce is indeed needed. As I have valid marriage cert., Photos of Marriage, and more. What should I do to prove legally.
3) what are the complication, if we apply for IR-1 Visa. As we have submitted Intent to marry letter in K1 Visa process.
